Draft and Proposed Rules - Asbestos Program

The Texas Department of State Health Services (Department) is proposing the repeal of the current Texas Asbestos Health Protection Rules located in 25 TAC Chapter 295, Subchapter C, Texas Asbestos Health Protection, §§295.31-295.73, in the November 11, 2016, issue of the Texas Register. In the same issue, the Department is proposing new 25 TAC Chapter 296, Texas Asbestos Health Protection Rules (TAHPR). This issue of the Texas Register is located on the Secretary of State’s website at http://www.sos.state.tx.us/texreg/pdf/backview/1111/1111is.pdf.  The proposed TAHPR begins on page 8916 of this document.

The Department will accept written comments on the proposed new rules during a 60-day formal comment period, until January 10, 2017.  A public meeting to receive oral comments on the proposed rules has been scheduled for December 12, 2016, from 1:30 p.m. to 4:30 pm at the Department of State Health Services, K-100 Lecture Hall, 1100 W. 49th Street, Austin, Texas 78756.

The Department will summarize and respond to written comments in a subsequent Texas Register issue. Any changes to rule text to incorporate comments will also be published. The effective date for the new rules is anticipated to be in May 2017.
