Program News - Ambulatory Surgical Centers

Law requiring human trafficking signage

Facilities Affected: Hospitals, Abortion Facilities, and Ambulatory Surgical Centers that perform abortions
Description: House Bill 2552, 85th Legislature, Regular Session, became effective on September 1, 2017. This bill requires all hospitals licensed under Health & Safety Code 241, and abortion facilities, including ambulatory surgical centers that perform abortions, to post human trafficking signage.
HB 2552 requires facilities to post separate signs in English, Spanish and any other language prevalent in the community. According to the bill, a facility must only display a separate sign in an additional language if it is in a political subdivision required to provide election materials in a language other than English or Spanish. Signs must be at least 8½ by 11 inches in size, with the notice covering at least four-fifths of the sign, and displayed in a conspicuous manner clearly visible to the public and employees. Sample signs have been created for your convenience, but facilities may create their own sign as long as it complies with the law.

Guidance concerning Centers for Medicaid and Medicare (CMS) Adoption of the 2012 edition of the National Fire Protection Association (NFPA) 101 - Life Safety Code (LSC) and 2012 edition of the NFPA 99 - Health Care Facilities Code (HCFC).

Facilities Affected: Hospitals, Ambulatory Surgical Centers
Description: The Centers for Medicare and Medicaid Services (CMS) final rule eliminates all references to the previously adopted 2000 edition of the LSC; and requires providers to comply with the 2012 LSC, with certain modifications and the 2012 HCFC, excluding chapters 7, 8, 12, and 13 by the effective date of July 5, 2016.  The final rule continues to allow CMS to waive, for periods deemed appropriate, specific provisions of the Life Safety Code, which would result in an unreasonable hardship upon a facility, providing the waiver will not adversely affect the health and safety of the patients.
