When submitting the Lead Abatement Notification via the Notifications Online System, the clock begins from the date the notification is submitted online.

When submitting via email, the clock begins from the date the Certified Lead Firm submits the notification directly to lead.notifications@dshs.texas.gov.

When submitting via United States Postal Service, the clock begins from the date of postmark on the notification.

When submitting via commercial delivery service/express mail, the clock begins from the date shown on the tracking as the commercial delivery services receiving the package/express mail.

Working days are defined as Monday through Friday, including holidays that fall on those days. No abatement work should begin until after seven working days from the date of notification to the department.

Holidays are considered working days if they fall on Monday through Friday. 

The start of the project can be on a non-working day. 

No. Photocopies are not accepted by the ELNS. The notification form must be complete, and only original signatures are acceptable. The notification form must be submitted to the ELNS via the Online Lead Abatement Notification System or by submitting a written Lead Abatement Notification Form via email, express mail, or hand-delivery.

The appropriate DSHS Regional Office must also be notified at the same time as the notification to ELNS. The DSHS Regional Offices will accept copies of the notification by fax, hand-delivery, or express mail, but must be received on the same date that the notification is sent to the ELNS. 

Original (Initial) Lead Abatement Notification:

The lead abatement notification fee for each original notification is $103. When submitting using the Notifications Online System, the submitter has an option to pay the notification fee at the time of submitting the original notification. If the notification fee is not paid at the time of the original notification submission, an invoice for the required fee will be sent to the firm or the alternate billing address provided on the original notification form after DSHS has received the notification.

Amending or Cancelling an Abatement Notification:

There are no additional fees associated with amendments or cancellations to original notifications. The original lead abatement notification fee of $103 still applies to a lead abatement notification even if it is cancelled. 

An amended Lead Abatement Notification will need to be submitted to the ELNS in Austin using an acceptable method of submission.

If the notification the ELNS has on file was submitted using the Notifications Online System and it has not passed the lead abatement project stop-date on the form the department has on file, the amendment can be submitted online by logging in with the same User ID as the user that submitter the prior notice. If the stop date has passed, the amendment must be submitted by USPS mail, express mail or email.

If the notification the ELNS has on file was submitted by the United States Postal Service (USPS) mail, express mail or email, an amendment must be submitted using one of those methods. Contact information can be found on the sidebar of this webpage.

Projects must notify the ELNS and the appropriate DSHS Regional Office by telephone* between 8:00 A.M. and 5:00 P.M. Central Time (CT) at least 24 hours prior to the start date, and a notification of cancellation must be submitted to the Environmental Lead Notifications Section via the Online Notification System, email, mail, express mail, or hand-delivery, and postmarked no later than 24 hours following the telephone communication with the Environmental Lead Notifications Section and the regional office.

In the event of lead abatement caused by an unexpected or unplanned or unanticipated lead exposure incident such as a child that was determined by a clinician to have an elevated blood lead (EBL) at or above reporting levels to the state, notification must be made as soon as practicable, but not later than the following working day after the occurrence of the incident. 

Initial notification shall be made by telephone to the ELNS in Austin and the DSHS Regional Office followed by formal notification via the Online Notification System, or on the DSHS notification form.

A separate lead abatement notification must be submitted for each individual and separate residential dwelling, or each building within a multi-family dwelling complex and a notification fee ($103) must be paid for each separate lead abatement notification. 

For changes in the start and/or stop date(s), please notify the ELNS in the central headquarters office in Austin and the appropriate DSHS Regional Office by telephone between 8:00 A.M. and 5:00 P.M. Central Time (CT) prior to the original start and/or stop date(s) previously specified on the notification form. 

Please submit your amendment via the Online Notification System or on the DSHS notification form with a postmark within 24 hours of the phone calls with the ELNS and the appropriate DSHS Regional Office.
