1.0 Purpose

The purpose of this policy is to provide for a clear line of responsibility in the area of data security and the maintenance of confidential TB/HIV/STD information.

2.0 Policy

Felipe Rocha, Section Director of the TB/HIV/STD Section, Department of State Health Services, is the ORP for the state of Texas. The name of the individual, who is designated as the ORP, rather than an organizational position, must be provided to CDC annually.

3.0 Definitions/Acronyms

Overall Responsible Party (ORP) – a public official with sufficient authority to make decisions about statewide TB/HIV/STD operations. The ORP is responsible for the security and confidentiality of all TB/HIV/STD systems.

THS – The TB/HIV/STD Section, which includes the HIV/STD Prevention and Care Branch, the TB/HIV/STD Epidemiology and Surveillance Branch, and the Tuberculosis and Refugee Health Services Branch.

4.0 Background

The Centers for Disease Control and Prevention (CDC) HIV/AIDS Surveillance Cooperative Agreement and the CDC National Center for HIV/AIDS, Viral Hepatitis, STD and TB Prevention Guidelines require each grantee to have a policy in place that names the person, or persons, who is the ORP.

5.0 Authority

CDC National Center for HIV/AIDS, Viral Hepatitis, STD, and TB Prevention Data Security and Confidentiality Guidelines (December, 2011).

6.0 Responsibilities

The ORP has responsibility for the security of all TB/HIV/STD systems (including processes, data, information, software, and hardware) and may have liability for any breach of confidentiality. The ORP is responsible for determining how information will be protected when it is collected, stored, analyzed, released and dispositioned.
